Relevant Person Representative (RPR)

A paid RPR is allocated when someone is placed under a Deprivation of Liberty Safeguards (DoLS) and there is no next of kin appropriate or available to represent them.

As one of the only providers of Out of Area RPRs in the UK, we make it easy for Local Authorities to source RPR's for clients who are placed both inside and outside of the Local Authorities in which they are an ordinary resident.

Our Advocates visit their Relevant Person's on a regular basis, and write a professional report which is submitted to the commissioning Local Authoirty. 

All our advocates are fully trained and supervised by a qualified IMCA to ensure the best service for vulnerable individuals who are deprived of their liberty under the Mental Capacity Act 2005.

Independent Mental Capacity Advocacy (IMCA)

Our fully trained IMCA's are a legal safeguard and provide support for vulnerable, unbefriended people who lack capacity to make certain decisions during the decision-making process.

Long Term Accomodation (LTA): An IMCA may be instructed to represent someone regarding a decision about where they move to. This includes hospital stays likely to last over 28 days or moving from one setting to another if the resulting stay is likely to last more than 8 weeks. 

Serious Medical Treatment (SMT): An IMCA may be instucted to represent someone regarding a decision around serious medical treatment. This can include an operation, a medically induced coma, or life sustaining treatment such as the placement of a neurogastric tube. 

Section 39A Independent Mental Capacity Advocate (39A): A section 39A IMCA is appointed to represent the Relevant Person during the assessment process when a request has been made for a standard authorisation.

Section 39D Independent Mental Capacity Advocate (39D): A section 39D IMCA may be appointed when a standard DoLS authorisation is in place and the person has an unpaid relevant person’s representative who requests support in their role.

Section 39C Independent Mental Capacity Advocate (39C): A section 39D IMCA may be appointed when a standard DoLS authorisation is in place and the person has either a paid or unpaid relevant person’s representative who abrubtly ceases to be able to represent the Relevant Person due to extenuating circumstances.  

COP DOL Reports & Rule 1.2 Representatives

Our trained Advocates are able to assist in the COP DOL process by visiting the client, discussing the client's needs and wishes with professionals and families involved in their care, and writing a statement regarding whether they think it is in a person’s best interests to have a package of care and support that would include depriving them of their liberty within a community or domestic setting. The statement informs a decision by the Court of Protection as whether to authorise the deprivation of liberty.

A Rule 1.2 Representative speaks for a person who lacks the capacity to consent to restrictions on their freedom, when they are, or may be, deprived of liberty in a community or domestic setting. The Rule 1.2 Representative will visit the client on a regular basis and produce a professional report for the commissioning Local Authority. 

 

Independent Care Act Advocacy (ICAA) & Independent Mental Health Advocacy (IMHA)

Our Care Act advocates support people to understand their rights under the Care Act and are fully involved in any Local Authority assessment, Care Reviews, Care and Support Planning or Safeguarding processes pertaining to our clients.

An IMHA is a specialist advocate with legal rights which are not available to other advocates. With these rights, an IMHA may:

  • Meet qualifying patients in private
  • Consult with professionals concerned with the patient's care and treatment
  • See any records relating to the patient's detention, treatment, or after-care, for the purpose of providing help to the patient and where the patient consents
  • Request access to records where the patient lacks capacity to consent, if accessing the records is necessary to carry out the functions as an IMHA.
